The Hartford Sees Drop In Number Of U.S. Workers With Disability Insurance

HARTFORD, Conn.–(BUSINESS WIRE)– According to new research from The Hartford, 49 percent of U.S. workers have short-term disability insurance and 44 percent have long-term disability insurance. This represents a drop of 6 percent and 3 percent, respectively, over last year’s survey in the number of Americans with the coverage that provides an income if one cannot work due to an illness or non-work related injury.

“We are concerned about the lower number of Americans who have coverage designed to provide a financial safety net,” said Ron Gendreau, executive vice president of The Hartford’s Group Benefits. “Approximately 2 million Americans have experienced a disabling illness or injury so far this year.  Based on our survey, about half of those workers will continue to have an income to help pay for expenses while they are recovering from their disability.”

The Hartford’s national survey also found:

  • 92 percent of Americans would need to make lifestyle changes if they lost part of their family income for three to six months;
  • 75 percent of consumers base their buying decisions on their fear of experiencing an unexpected financial hardship; and
  • Only 25 percent of workers completely understand disability insurance.

“People understand the importance of insuring their home,” Gendreau said. “Yet by not protecting their paycheck, consumers are essentially putting their home at risk. Consider that losing your income for two years can be the financial equivalent of losing your home.”

2011 EEOC Statistics Reveal Disturbing Trends Every Employer Should Know

DDRINSThe Equal Employment Opportunity Commission (EEOC), the government agency responsible for enforcing Title VII, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), the Genetic Information Nondiscrimination Act (GINA) and the Equal Pay Act (EPA), has released fiscal year 2011 enforcement statistics.

Total charges were 99,947 for 2011, setting a new record. Despite the record number of charges, the EEOC, for the second year in a row, resolved more charges than it took in. Total resolutions increased seven percent over 2010. The Commission touts a ten percent decrease in inventory for the first time since 2002. Approximately, 78,136 charges are still pending.

As far as litigation in 2011, the agency filed 300 lawsuits resulting in $91 million for claimants. The number of lawsuits filed has increased for the past three years.

Retaliation claims were the most numerous at 37,334. Race discrimination charges followed with 35,395 charges. The other three most frequently cited allegations were sex, disability and age discrimination.

Only 245 claims were filed under GINA in 2011. However, 2011 was the first full fiscal year for enforcement of GINA. GINA prohibits discrimination based on genetic information and family medical history.

The EEOC’s enforcement of ADA claims produced the greatest increase in monetary relief last year. Administrative relief for ADA claims increased almost 35.9 percent from $76.1 million in 2010 to $103.4 million in 2011. Back impairments, followed by other orthopedic impairments, depression and diabetes, took the lead for the most frequently cited impairments. “Private Sector Bias Charges Hit All-time High,” www.eeoc.gov (Jan. 24, 2012).

COST EFFECTIVE LEGAL DEFENSE TO PROTECT YOUR BUSINESS

Doherty, Duggan and RouseIt’s no secret that insurance companies hire from among the best attorneys available, and those attorneys defend you when you get into a legal incident covered by a liability policy that you have secured. But you might ask these two questions: Is it still cost effective to get such legal defense through an insurance policy and what policies does a business need to secure to get the best legal guns to defend themselves in a given situation?

If you get an attorney demand letter or any kind of notice of legal action, who do you call? Well you can always call an attorney who might be a friend, done a trust for you, or might have put together some contracts for you, but would they be the best litigation attorney for you if it came to that?

Keep in mind the plaintiff will probably know if you have a qualified attorney or not and that will dictate how they will proceed and how much they are willing to settle for. Also, in many cases those taking action against you, most especially if it is frivolous, would rather not face an insurance company attorney and this puts you in a much better position.

What should I report when filing an insurance claim?

DDRINS Report as much as you know.

Explain what has happened and provide copies of all relevant documents. Upon receipt of a notice of claim, insurers have no obligation to investigate and  will likely respond to the notice by asking you you to provide a clear summary of the circumstances surrounding the claim notice.

 

Send copies of all relevant documents including:

  •  Relevant contracts
  • Letters from the claimant and/or his attorney
  •  A copy of a lawsuit if it one has been filed

Sending complete information in when providing first notice will expedite the investigation process, shorten the time between your notice to the insurer and your receipt of information about whether the claim is covered.

When should you file a claim?

DDRINSReport a claim early. Even if you think you actually don’t have a “claim”, if you are unsure or think a claim might be coming, you should go ahead and report what you know to your insurer. You can report as notice of a potential claim. Most insurers won’t increase the premium charged when a policy is renewed just because the insured gave notice of a potential claim during the expiring policy period.

If you do have a claim, you should not delay in reporting. Depending on what “triggers”  coverage your policy, you may be required by the terms of the insurance policy to report a claim promptly or in the case  of a “claims-made-and reported” policy, prior to expiration of the policy. Furthermore, aside from the terms of the policy, in some states “late notice” of a claim is justification for the insurer to deny the claim even it’s position has not been harmed by the delay.

Additionally, even if the carrier doesn’t deny coverage due to late notice, they may refuse to pay for expenses you incurred in handling the claim prior to notice to them.

There is no good reason to delay in reporting a claim and there are very good reasons to report sooner instead of later.

Understanding Your Home Insurance Policy

DDRINS Home Insurance policies are long, complicated and written in legalese. But it can really pay to know what’s in yours and how it works.

Finding an Insurer

Get recommendations from friends, relatives, co-workers or other people you trust. Be sure to check out the companies.If your state keeps information, complaints or complaint ratios, weigh that too.

You can find information about how to contact your state insurance office at www.naic.org. Make sure the company is on strong financial ground so it will be there if you have to file a claim. Check its ranking with A.M. Best Company.

Your Dwelling

You want to be sure that if you had a total loss of your home tomorrow, your homeowners insurance policy would pay enough to build the exact same house in the same spot.

Don’t just focus on what you paid for the home. You want enough insurance to replace it, right down to that funky wallpaper.You also want to consider how home values and construction costs in your area would affect you if you needed to rebuild.

If you’ve made any renovations, talk to your agent. Find out what he or she needs to document the changes and the value you’ve added to your home.

Replacement Value

After a loss, if you want the insurance company to reimburse you for the cost of a new version of your possessions, then you want replacement value insurance for your belongings. In other words, the company pays you to replace what was lost.

But you might have to request it because not all policies have replacement value as the default coverage. Beware of policies that promise “fair market” or “cash value.” That means the company will give you the current value of the item, which will include wear and tear and depreciation. It also can make more work for you during a claim, since you have to substantiate not only the fact that you owned the article, but also what it was worth when you lost it.

It also pays to ask how your company handles claims with replacement value insurance. Some firms want you to purchase the new item and show a receipt before reimbursement. If that’s the case, how much time do you have?  And if you decide not to replace the item at all how will the company reimburse you?

Deductibles

Just as with auto insurance, the higher your deductible, the lower your premium. If disaster struck, what’s the most you could afford to pay all at once? That’s your deductible. If you want to increase it, start socking money into a nest egg account. The next time you renew your homeowners insurance, increase your deductible by the amount you’ve saved. (Extra points: Take the money you save in premiums and put it into savings.)

Liability Insurance

If a contractor slips and breaks his leg while repairing your roof, liability will cover you. Make sure you have enough to protect yourself financially. People can even file a suit if they have been drinking at a party you are throwing, leave and have an auto accident.

If you have some high-dollar assets, consider an umbrella policy. Properly tailored, it should kick in where you homeowner’s liability leaves off. And you likely can buy up to a $1 million in coverage for a few hundred dollars, according to estimates from the Insurance Information Institute.

Living Expenses

Sometimes called “loss-of-use coverage,” this is what the insurance policy would pay toward your living expenses after a loss while your home is being repaired or rebuilt. Find out under what circumstances it would kick in, what it would pay and for how long.

Apartments and Condos

If you live in an apartment, your landlord will have insurance on the building, but you need to carry insurance for your possessions (often called “contents insurance” or “renters insurance”). In addition, some landlords will require that you also carry liability insurance in case anyone is injured while doing work inside your home.

If you own a condominium, you want to find out what areas are covered by the association and what you’ll need to insure. As well as your own belongings, it’s possible that you need to insure a portion of the structure. Check with your association attorney or management company before you buy and find out exactly what type of policy you’ll need.

Your CLUE Report

Many insurance companies participate in a claims database exchange in which claims information is stored by name and address. Insurance companies can then pull a report on an individual or location, just as a potential lender can pull a credit report. The most widely known claims database reporting system is called the Comprehensive Loss Underwriting Exchange, or CLUE.

If there have been a multitude of claims, or someone in the home has reported a particular problem, such as water or mold that raises red flags, you could have trouble getting insurance. Before you buy, ask the owner for a recent copy of the CLUE report so you know what you’re getting. And keep your claims to a minimum.
