Conduct an Investigation into Workplace Injuries

Doherty, Duggan and Rouse InsurorsEvery employer should be prepared to conduct their own on the spot workplace injury investigation. In cases of serious injury, or injuries of a questionable nature, early intervention by the employer is essential. By being proactive, an employer can more readily reduce their liability to exposure by preventing a situation from spiraling out of control rather than engaging in a costly court action.
The main reasons to investigate are:

  • This is your only opportunity to conduct your own discovery into the cause or legitimacy of the injury while the incident is fresh.
  • Allows you to obtain the witness versions of the incident before details are forgotten, in some instances to prevent possible deception or collusion.
  • Provides the best opportunity to understand the underlying cause of the incident and to make an informed management decision.

Understanding How to Conduct an Investigation

Every investigation is really nothing more than a step-by-step logical process. You are best served to have specific individuals designated to perform the investigation.

Your purpose as an investigator will be to determine whether the alleged workplace injury had a casual connection with the worker’s employment. You want to know whether the worker was exposed to a particular danger or possibly some other risk peculiar to the worker’s actions at the time of the alleged injury.

Your designated investigator must have a thorough understanding of applicable state and federal laws. Personnel information and the results of the investigation need to be confidential and relayed to only those people who need to know.

All investigations must be conducted objectively and without making assumptions or jumping to conclusions. Training immediate supervisors to provide as much detail as possible is also critical to a successful investigation.

Investigations Basics

These are some of the essential steps in the investigative process:

1. Preserve the Injury Site

Try to preserve the injury site as long as it is viable or to satisfy legislative requirements. At the very least do whatever is possible to present a detailed and thorough representation of the injury site. If necessary, gather any physical evidence and store separately in a locked area. Use plastic bags to preserve and seal the integrity and prevent contamination of the physical evidence as necessary.

2. Document the Injury Site

Before removing any physical evidence, document the site by taking videos of the accident, or take detailed pictures. Draw a diagram and show the distances and physical locality of each piece of evidence. Take note of serial numbers or any other manufacturing information that relates to the process or physical equipment involved. Service records and maintenance reports should also be secured as they relate to the equipment involved.

3. Perform Statement Taking

Where possible and depending on the severity of the injury your task would be try to get a statement from the worker first and foremost, but not at the expense of medical treatment of course.

Secondly, it is especially vital to take the names of all available witnesses and interview them as soon as practical. Sequester each witness separately if possible to avoid comparing of stories or possible collusion to commit or abet potential fraudulent claims. Stress to each witness that they are not to discuss the incident with other witnesses or even other co-workers.

Written statements should be taken in the witnesses own words. Avoid leaving blank spaces and have each witness sign and date the witness statement.

Be Proactive

By taking responsibility at the outset to determine the cause of a workplace injury, you can quickly determine the validity of a Workers Compensation or disability claim. If something questionable arises, you will have detailed documentation to address contentious and possibly litigious issues before they go the distance.

The importance of safety equipment in construction

Whether it be driving, using the lawn mower, or trimming bushes, it’s easy to let safety slip your mind. In construction, however, professionals do not have this liberty because the daily tasks they participate in can be far more dangerous. Complacency in the work place could result in serious injury.  That is why it is so vital for construction professionals to operate machinery and equipment in the safest possible manner, as well as use the necessary safety equipment to protect themselves.

Safety equipment can range from hard hats and gloves, to eye protection and first aid kits. No matter the type of construction your job requires, do not overlook your safety equipment needs. The most common types of safety equipment needed on construction sites, or at home, are work gloves and and eye protection or safety glasses. Because these items are so common, many variations exist and you are sure to find the pair of either that best suits your needs. From clear safety glasses and safety sunglasses to safety over-glasses and prescription safety glasses, the options are limitless. Clear safety glasses tend to be the most common style available. These glasses generally don’t provide any side or peripheral protection, thus are typically considered to be ‘head-on’ protection. Don’t let style or fit be an excuse for not purchasing safety glasses, there are too many options for those to be legitimate reasons!

Work gloves tend to be even more important on a wider array of jobs. Protect your hands from abrasive materials, cuts, and blisters. Keeping your hands in top condition will be crucial to the success of your project. There are work gloves designed for just about any application. From knit gloves with rubber dots for increased grip in cold weather, to rubber-coated abrasive resistant gloves for moving abrasive building materials.  Choose the style and size of glove that best suits your needs.

Eye and hand protection tend to be the most common and important protection on light to medium-duty construction sites. However, heavy construction, particularly commercial and industrial building applications often require the use of hard hats and other safety equipment like harnesses and steel-toe boots.

Invading Pests Threaten Georgia’s Forests

Doherty Duggan & RouseThe Georgia Forestry Commission is launching a major offensive against two destructive pests that have the potential to decimate significant portions of our state’s healthy forestland. Custom traps are being hung throughout the state to detect and respond to possible incoming infestations of emerald ash borers and gypsy moths.

“Emerald ash borers have been found as close as 55 miles from the north Georgia border in Tennessee,” said Chip Bates, forest health coordinator with the Georgia Forestry Commission. “Since the late 1990′s, these tiny insects have been spreading through 15 states from Michigan southeastward and they’ve caused tree mortality in the billions of dollars. They are a serious threat to Georgia’s beautiful forests.”

The Georgia Forestry Commission is working with several partners to hang some 800 special, purple traps statewide to aid in early detection and rapid response to any emerald ash borer activity. The cooperative effort includes the Georgia Department of Agriculture, the University of Georgia’s Warnell School of Forestry and Natural Resources, Trees Atlanta and U.S. Department of Agriculture Animal Plant Health Inspection Service. The small, green insects are drawn to the traps because they contain a beetle pheromone and an ash tree scent. Emerald ash borers are capable of killing an ash tree in as few as two years and they are transported primarily by humans, who inadvertently move them on firewood or on vehicles. For this reason, Bates said traps are being positioned near major transportation corridors, including Interstates 75, 85 and 95. They are also being hung in state and federal parks, campgrounds and metro Atlanta, among other locations statewide.

Special, smaller traps are also being hung to capture gypsy moths, another destructive pest that targets hardwood trees, especially oaks. During epidemic population levels, entire forests can be stripped of their leaves, and several years of defoliation can lead to tree mortality. Trees stressed by environmental factors such as drought can be particularly hard hit by defoliation. Past outbreaks in White, Fannin and Rockdale Counties were successfully eradicated and while there are no known infestations currently in Georgia, the threat is always present.

“The impact of emerald ash borer or gypsy moth infestations would be felt by everyone in Georgia,” said Bates. “Homeowners, timber growers and wildlife managers would not only face huge expenses for removing diseased trees, but the visual fallout can be truly shocking. We can all help by never transporting firewood from the wood’s origin and by washing down any vehicle that’s traveling from a potentially infested area.”

7 Tips to Stay Safe from Drunk Driving/Drivers This New Years Eve

DDRINSDoherty,Duggan and Rouse Insurors, not only wants you to have a festive time bringing in the New Year but also remember, buzzed driving is also drunk driving. If we can educate people that buzzed driving is also unacceptable and will also cause  car accidents, we are saving lives.
 

Here are 7 New Year’s Eve safety tips:

 

1. Have a designated driver: Do not ever drink and drive. Ask a friend or a family member for a ride, or make a reservation for a taxi.

2. Monitor your alcohol intake: Many people associate New Year’s Eve celebrations with drinking. Be aware of how much you are drinking. Make sure you stay hydrated (with water) and that you eat enough.

3. Take the keys: If you have a friend who is too drunk to drive, take the keys. Get your friend a ride home with a trusted sober driver, or call his or her family for a ride.

4. Stick together: Going to parties, bars and dance clubs can be hectic, and with too much alcohol, some people lose control. Traveling in groups creates a safety net.

5. Stay off the roads: Drinking and driving car accidents are highest between 8 p.m. and 2 a.m., so try and stay off the roads during those hours.

6. Drive defensively: If you must drive, be aware of your surroundings, drive defensively and call the police if you see anything illegal or suspicious taking place. As always, wear your seat belt and don’t drive distracted.

7. If you’re hosting a New Year’s Eve party, adhere to the following safety suggestions:

•    Have a ride for your guests: Contact a local cab company so your guests can have rides.

•    Juice, soda, water: Also serve non-alcoholic beverages for your guests. Have lots of water on hand.

•    Plenty of food: Make sure you have enough food on hand so your guests can have something on their stomachs beside alcohol.

•    Stop serving: Stop serving alcohol well before the party ends.

•    Sleep over: Let your guests stay the night if they wish to stay off the roads.
