Could You be Sued?

[ 0 ] May 14, 2012

The Burns AgencySome individuals, particularly wealthier ones, have a higher than normal loss exposure to lawsuits. This tendency is often referred to as a suability factor. How suable you are can be determined by examining the following:

  • Size of your savings account and stock portfolio
  • Size of your real estate holdings
  • Family income
  • Profile in the community and media
  • Leadership activities on not-for-profit boards
  • Leadership activities in home owners’ associations
  • Future income (this one’s important, especially for young people to understand: you may not have much now, but your future wages may be garnished)

People with a low suability factor should still strongly consider procuring a personal umbrella policy with at least $1 million in liability limits. People with a high suability factor nearly always need a personal umbrella policy with at least a $2 million limit. Remember that this is a relatively inexpensive policy that provides excess liability coverage over your homeowners and personal auto insurance policies. In some cases, it provides broader liability coverage than that found in the underlying policies.

The Burns Agency is a local independent agency that represents multiple insurance companies, so we offer you a variety of personal and business coverage choices and can customize an insurance plan to meet your specialized needs. Picasso A FRAUD, But KAC Rocks On!

[ 0 ] May 12, 2012

Picasso A FRAUD, But KAC Rocks On!

The Kirkland Art Center planned to auction a signed Picasso lithograph as part of KAC Rocks On, an evening of art and music to benefit the organization. The Picasso print was part of the KAC’s permanent collection, and a certificate of authenticity was on file. In preparation for the sale of the piece, however, staff sought verification of authenticity. This effort ultimately revealed that the piece was counterfeit. The Federal Trade Commission prosecuted the gallery owner who had originated the fraud as part of an industry-wide investigation of art dealers across the United States.

Do I Have Any Control Over My Auto Insurance Premiums?

[ 0 ] May 9, 2012

The Burns AgencyIn today’s market, where affordable personal auto insurance seems less and less available, you may wonder if there’s any way to control rising premiums.

You’ve already taken one step by choosing an independent insurance agent, representing multiple companies, so we can give you the right insurance to fi t your needs.

Besides choosing the right insurance company, there are some other tips to help you control the rates you pay for auto insurance.

Driving record

An operator’s driving history affects rates and could predict future claims activity. Obeying the rules of the road and driving defensively are your best ways to lower premiums.

Type of vehicle

A major factor in the rating of the coverages that pay to repair your car is the type of vehicle you own. In assigning a rate, most insurance companies begin with the cost of the vehicle and the model year. Generally, the higher the cost of the vehicle and the newer it is, the higher the rate. However, further adjustments are made for the vehicle’s weight, body type, engine performance, actual loss experience from past years for that model, etc. We can give you a premium comparison for vehicles you are considering purchasing or leasing, which will give you some control over the cost of your insurance.

Coverage

Some people prefer to assume more of the risk of loss on their autos and save on premiums. It may make sense for you to remove coverages on older vehicles, or increase your deductibles on newer vehicles. A common rule of thumb is that for vehicles more than 10 years old, many do not cover them for other-than-collision (or comprehensive) or collision coverage (physical damage). However, to obtain glass coverage on a vehicle, you would have to maintain other-than-collision coverage.

Use and residence

Your employment opportunities and life style most likely will dictate the kind of use your vehicles get and the location at which they are garaged—two things that impact your premiums. However, there is a way you can gain some control over the rating of your vehicles. You may want to consider driving the lowest-rated vehicle (for example, an older vehicle without physical damage coverage) for activities that have the highest rate for use (for example, business use or long-distance commuting to work). Timely premium payment Always pay your premiums on time. Issuing cancellations, processing late payments and then issuing reinstatements, add significant costs to the servicing of auto insurance policies. Some companies have a low tolerance for late payments under policies that are eligible for their preferred pricing.

Credit management

Many insurance companies have established a link between a person’s credit history and that person’s probability of having a car accident. As strange as this may sound, there appears to be an objective basis for using credit analysis, known as insurance credit scores, to predict which policyholders will have greater-than-average loss experience or less-than-average loss experience. Managing your credit and your credit report will help to lower rates on your auto insurance.

Discounts

There are some standard discounts, such as those for taking a driver-training course or a defensive-driving course, qualifying as a good student, insuring multiple vehicles on the same policy, installing certain anti-theft devices and maintaining certain safety equipment (for example, passive restraints, anti-lock brakes or good student discounts). Some insurance companies have developed their own discounts for such things as buying your homeowners policy from the same company. Our agency would like you to take advantage of every discount that is available to you, so don’t hesitate to call us for a discount review.

Fight fraud

Lawmakers are working on bills that would help prevent fraud. If you are concerned about your auto insurance costs, be sure to contact your state legislators and urge them to reach agreement on reforms to drive the cost of fraud out of the state’s auto insurance system.

Give us a call today to find out more information on how you can get the most from your policy.

Homeowner Insurance

Request a Homeowner Insurance Quote.

Homeowners insurance includes homeowners, renters, condo owners and mobile homeowners.

The biggest asset for most people is their home. Lose that, and you will likely lose a big part, if not most, of your net worth. Even if you don’t own, but rent, you can still easily lose all your belongings in a sudden fire. That’s where homeowners insurance comes into play.

Homeowners insurance will not only cover a home structure, it will cover the contents as well. Of course, all of this depends on how much coverage you purchase and whether you have any add-ons, known as endorsements, attached to your policy.

Homeowners insurance also covers you for liability should someone be accidentally injured by you, your children or pets while on or off your premises. Coverage for damage to property of others is also included in the liability section of homeowners insurance policies.

Homeowners will also cover damage to some of your possessions that are not located at your home. This includes damaged luggage on a trip or property stolen from your car.

Homeowners insurance is divided into several types of coverage:

  • Dwelling coverage is provided for your home.
  • Other Structures coverage is included automatically at a limit usually equal to 10% of the dwelling limit on your policy. Additional coverage can be purchased if a higher limit is needed.
  • Personal Property is included at a limit typically equal to 70% of the dwelling limit. It may be 50% if you do not opt for replacement cost coverage. Renters will choose a limit sufficient to cover their belongings. This limit can be increased if desired.
  • Additional Living Expense covers the extra expenses you might incur if your home should become uninhabitable due to a covered loss. This coverage is generally provided at a limit equal to 20% of the dwelling coverage – or 20% of the personal property limit on a renters policy.
  • Personal Liability covers you for claims of injury to, or damage to the property of, others.
  • Additional coverage endorsements for boats, collectibles, in-home businesses and more are available.

Cyber Liability and Identity Theft – read on, this IS important

[ 0 ] April 23, 2012

The Burns AgencyDo you handle Personally Identifiable Information of your customers/clients/employees?  If so, this is very important information for your business or your employer.  It is also important for you, as a consumer, to think about what is happening to your information as businesses use it.

This type of loss goes by many different names [Cyber Liability, Identity Theft, Data Breach, Lost Data, Privacy/Security Breach], but it is an exposure that needs to be addressed by every type of business.  Many people think of data breaches as being caused by hackers or criminals, however, the biggest exposures come from human error – which is very difficult to control.

Almost every state has laws regarding notification, credit monitoring, etc. if your client, employee, or customer’s Personally Identifiable Information (PII) has been (or may have been) breached or compromised.  These laws apply regardless of whether or not this information was actually used in a fraudulent manner.

Data breaches cost millions of dollars per incident in direct costs and even more when indirect costs are plugged in.  A 2011 study found that breaches cost businesses, on average, $214 per compromised record; or an average of $7.2 million per data breach event (Ponemon Institute).  The direct costs such as notification costs, credit monitoring, legal defense, public relations, etc. are just the beginning. Indirect costs such as lost business and internal time spent on a breach increases this number significantly.

For those clients who respond too quickly to a breach, the cost soars by as much as 54%! The rush to notify, to comply with regulations such as HIPAA, HITECH act, or State and Federal laws can increase the costs, because you may over-notify or not properly notify those affected, and end up having to re-notify.

Malicious or criminal attacks were 31% of the breaches; these attacks come from both inside and outside organizations. Malicious attacks are more costly because they are harder to identify.  Often times these breaches are caused by internal employee carelessness in regard to security compliance. Negligence is the leading cause of data breaches – at 41%

Lawsuits against firms for negligent handling of personal information are becoming more common – even if your business wins the suit, the defense costs can be devastating.

For more information on how to help your business comply with PCI Data Security Standards, which will help to substantially reduce your risk of loss and keep your business in compliance with state and federal regulations, go to https://www.pcisecuritystandards.org/merchants/

To protect your business from the expense of this type of loss – which is not covered on a standard insurance policy – contact The Burns Agency for a Cyber Liability Insurance premium indication.  And to protect yourself from Identity Theft ask us if an endorsement is available to provide this coverage on your Homeowners or Tenants policy.  If you have any questions please call us at 315-853-5052, we’ll be happy to help!
